1. Agreement
Welcome to holidaylightco.com (the "Site"). The Site is operated by Holiday Lighting 4U LLC, doing business as Holiday Light Co ("Holiday Light Co," "we," "us" or "our"). By using the Site, you agree to these Terms & Conditions (the "Terms"). If you do not agree, please do not use the Site. Please read these Terms carefully and keep a copy for your reference.
Holiday Light Co is a full-service holiday and year-round lighting company. These Terms cover your use of the Site. The lighting work we do for you is covered by the written agreement you sign with us for that project.
2. Privacy
Your use of the Site is also subject to our Privacy Policy (holidaylightco.com/privacy-policy). It explains how we collect and use information, including Google Analytics and cookies, and your choices: the "Do Not Sell or Share My Personal Information" link and Global Privacy Control.
3. Electronic Communications
When you visit the Site, send us a form, or email us, you are communicating with us electronically. You agree that agreements, notices, disclosures and other communications we send you electronically, by email or on the Site, meet any legal requirement that such communications be in writing.
4. Text Messaging (SMS)
Program. Holiday Light Co sends text messages only to people who agree to receive them, using the optional checkbox on our contact forms. If you agree, we may text you about appointment confirmations, project coordination and service updates, at the mobile number you gave us.
Consent is optional. Consent to receive text messages is not required to submit a form or receive our services, and it is not a condition of purchase.
Frequency and cost. Message frequency varies (typically 1-4 per month). Msg & data rates may apply.
Opting out and help. Reply STOP to any message to opt out at any time. Reply HELP for help, or contact us at (602) 478-9410 or hello@holidaylightco.com.
Privacy. Mobile information is not shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.
Carriers are not liable for delayed or undelivered messages.
5. Children
Holiday Light Co does not knowingly collect personal information, online or offline, from anyone under 13. If you are under 18, you may use the Site only with the permission of a parent or guardian.
6. Links to Other Sites and Third-Party Services
The Site may contain links to other websites. We do not control those sites and are not responsible for their content or for any changes to them. We provide these links only as a convenience. A link does not mean we endorse the site or are associated with its operators.
Some services offered through the Site are delivered by third parties. By using a product, service or feature on the Site, you agree that Holiday Light Co may share information with the third parties we contract with to provide it to you.
7. Use of the Site and Intellectual Property
We give you a limited, non-exclusive, non-transferable, revocable license to use the Site in line with these Terms. You agree not to use the Site for anything unlawful or prohibited by these Terms; not to damage, disable, overload or impair the Site, or interfere with anyone else's use of it; and not to obtain, or try to obtain, any material or information through means we did not intentionally make available.
All content on the Site, including text, graphics, logos, photos and software, and the way it is arranged, belongs to Holiday Light Co or its suppliers and is protected by copyright and other intellectual property laws. You may view it for your personal use only. You may not copy, modify, publish, transmit, sell, create derivative works from, or otherwise exploit it without the written permission of Holiday Light Co and the copyright owner. You must not remove or change any copyright or other proprietary notice.
Using the Site gives you no ownership of any content, and no license to our intellectual property except as these Terms state.
8. International Users
We operate the Site from the United States. If you use it from another country, you are responsible for following your local laws.
9. Indemnification
You agree to indemnify, defend and hold harmless Holiday Lighting 4U LLC and its officers, directors, employees and agents from any losses, costs, liabilities and expenses, including reasonable attorney's fees, arising from your use of the Site, your breach of these Terms, your violation of any law, or your violation of anyone else's rights. We may, at our own cost, take over the defense of any such matter, and you agree to cooperate with us.
10. Disclaimer of Warranties
THE SITE AND ALL INFORMATION, CONTENT AND SERVICES ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT THE LAW ALLOWS, HOLIDAY LIGHTING 4U LLC AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. THE SITE MAY CONTAIN ERRORS, AND WE MAY CHANGE IT AT ANY TIME.
This section covers the Site only. Any warranty on our installation work, such as our Quality Assurance Warranty, is set out in your project agreement.
11. Limitation of Liability
TO THE FULLEST EXTENT THE LAW ALLOWS, HOLIDAY LIGHTING 4U LLC AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF USE, DATA OR PROFITS, ARISING FROM OR CONNECTED WITH THE SITE, ITS USE, ANY DELAY OR INABILITY TO USE IT, OR ANY INFORMATION OBTAINED THROUGH IT, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.
Some states do not allow these limits, so they may not apply to you. If you are unhappy with the Site or these Terms, your only remedy is to stop using the Site.
12. Termination
We may end or limit your access to the Site, or any part of it, at any time and without notice.
13. Governing Law
To the fullest extent the law allows, these Terms are governed by the laws of the State of Arizona, and you agree that the courts in Arizona have exclusive jurisdiction over any dispute arising from or relating to the Site.
14. General
These Terms do not create any joint venture, partnership, employment or agency relationship between you and us. Nothing in these Terms limits our right to comply with law enforcement, court or government requests about your use of the Site.
If any part of these Terms is found invalid or unenforceable, it will be replaced by a valid provision that comes closest to its intent, and the rest of these Terms stays in effect.
These Terms are the entire agreement between you and us about the Site, and they replace any earlier communications about it. A printed copy of these Terms, or of any notice we give electronically, may be used in legal proceedings like any other business record.
15. Changes to These Terms
We may change these Terms at any time. The version posted here, with its effective date, replaces all earlier versions. Please review these Terms from time to time.
